These Terms of Service (“Terms”) are a binding agreement between you and Irondale Village, Inc., a Florida corporation doing business as VidFuse (“VidFuse,” “we,” “us,” or “our”). They govern the VidFuse mobile app, websites, recording sessions, invitation links, subscriptions, cloud features, exports, and related services (the “Service”). Our notice address is 4878 S Lake Dr, Boynton Beach, FL 33436, United States. By accessing or using the Service, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.
These Terms supplement Apple’s Standard Licensed Application End User License Agreement (“Apple Standard EULA”), which also applies to an App Store download. They do not replace it. If these Terms conflict with the Apple Standard EULA, the Apple Standard EULA controls only to the extent required by Apple or applicable law.
1. Eligibility and Accounts
If you are below the age at which you may accept these Terms for yourself, a parent or legal guardian must authorize your account, review and accept these Terms for you, and supervise your use as required by law. A child under 13 may use VidFuse only after the parent- or guardian-managed authorization required by VidFuse has completed. You must provide accurate information, protect your device and sign-in credentials, and promptly report unauthorized account use. You are responsible for activity through your account and for confirming recipients before sending content or invitations; when a guardian authorizes a child account, the guardian is responsible for supervising that use.
One person may use the same account on multiple authorized devices, but you may not transfer, sell, or share your account with another person. Account identity is used to authorize invitations, participants, devices, entitlements, and deletion requests.
Where available or required, VidFuse uses age-category and parent or guardian approval information supplied through Apple’s privacy-preserving system features. A new sign-in remains provisional and cannot use VidFuse services until the applicable age and authorization checks succeed. We may deny or restrict account access if required approval is missing, denied, withdrawn, unavailable, or incomplete. VidFuse does not request an exact birth date or identity documents for this process.
2. What VidFuse Does
VidFuse helps compatible devices record, synchronize, transfer, edit, analyze, export, save, and share video and audio. Nearby sessions primarily use local device-to-device discovery and transfer. Anywhere sessions, accounts, invitations, entitlements, and some transfer or recovery operations use VidFuse cloud infrastructure. Features depend on permissions, devices, networks, cloud services, and participant actions.
VidFuse is not an emergency, safety, surveillance, evidence-preservation, regulated-data, or guaranteed-backup service. Features, limits, quality, compatibility, and availability may change. Keep original footage until you verify the final export.
3. Recording and Consent
You are responsible for obtaining all notices, permissions, releases, and consents legally required to record, process, transfer, edit, publish, or share every participant, bystander, voice, location, performance, and item appearing in content. Recording, wiretap, privacy, publicity, and intellectual-property laws vary and may require every participant’s consent. Do not record where prohibited or where privacy is reasonably expected. A VidFuse invitation, connection, or participant action may show participation, but it does not replace consent required by law. Stop recording when required by a valid objection or applicable law.
4. Your Content and the Limited License to VidFuse
You retain ownership of content you lawfully own. You grant VidFuse a worldwide, nonexclusive, royalty-free license to host, copy, transmit, format, analyze, modify, combine, display, and otherwise process your content only as reasonably necessary to authenticate users; operate, secure, troubleshoot, and support the Service; perform features and edits you request; comply with law; and maintain limited backups and recovery safeguards. The license ends when those purposes and the applicable retention periods end.
This license does not permit VidFuse to use your content for advertising, unrelated commercial use, generalized product research, training general-purpose or third-party AI models, or improving unrelated products. Any future program using content for such purposes would require separate, explicit, optional consent that explains access, retention, withdrawal, and deletion.
You represent that you have all rights needed for the content—including music, reference media, trademarks, performances, likenesses, and voices—and that its use will not violate law or another person’s rights. Other participants may receive lasting copies. VidFuse cannot retrieve or control copies exported, transferred, saved, or shared outside VidFuse-controlled systems.
5. Private Collaboration, Blocking, and Reports
VidFuse provides user-directed sessions, invitations, squads, transfers, and exports. It does not provide a public feed, public user search, or public comments. Invitations may still be misdirected or forwarded, and other users may misuse accounts or platform features.
Use available controls to refuse invitations and block accounts. Blocking is intended to prevent both accounts from initiating or accepting new VidFuse connections with each other, subject to reasonable technical delay and legal or security exceptions. Unblocking does not restore a prior Squad relationship or invitation.
Use the in-app reporting control to report suspected platform abuse involving an account, invitation, session, or interaction. A report sends the reported account, selected category, optional description, and minimal relevant service identifiers so VidFuse can investigate misuse of its accounts and connection services, respond to the reporter, and disable an account when appropriate. Automated systems may validate, group, prioritize, route, and count reports, but do not disable an account based only on reports. It does not automatically upload or preserve a recording. If a recording or other evidence is needed, support will request it separately and you decide whether to provide it after receiving information about its purpose, access, and retention. The VidFuse support form remains available when the in-app control cannot be used.
6. Acceptable Use and Safety
You may not use the Service to exploit or endanger minors; harass, threaten, stalk, impersonate, defame, discriminate, or invade privacy; distribute child sexual abuse material, nonconsensual intimate imagery, unlawful content, malware, spam, or fraud; infringe intellectual property; bypass security, entitlements, watermarks, usage limits, blocks, or access controls; reverse engineer except where law permits; scrape, overload, disrupt, or misuse the Service; or help another person do so. Do not use VidFuse while driving or where device use is unsafe.
We may investigate platform activity, restrict features, preserve limited records, report conduct, or suspend or terminate access when reasonably necessary. Because VidFuse does not routinely possess locally stored or already transferred content, we may be unable to inspect or remove it. We do not proactively scan private recordings unless required by law or necessary for a separately disclosed feature or safety process.
7. AI and Automated Editing
AI Director and other automated tools may analyze timing, audio activity, motion, focus, faces, framing, and technical quality to suggest or render edits you request. This processing is used to provide the requested feature, not to identify people through a biometric identity database. Outputs may be inaccurate, incomplete, biased, repetitive, unavailable, or unsuitable. Review every cut, crop, caption, synchronization choice, and export before relying on or sharing it. You remain responsible for the final content. VidFuse does not guarantee creative quality, factual accuracy, rights clearance, or a particular result.
8. Invitations, Messages, and Third-Party Services
You may invite people through universal links, Messages, SMS/MMS, WhatsApp, AirDrop, or other services. Verify the recipient and do not send spam, deceptive invitations, or unlawful marketing. Your carrier, internet provider, Apple, or another app may charge message, data, roaming, subscription, or other fees. Delivery, opening, compatibility, and confidentiality are not guaranteed.
Apple, Google, Amazon Web Services (“AWS”), social networks, messaging apps, wireless carriers, and other providers may supply authentication, billing, hosting, links, transfers, or sharing. Their terms and privacy policies apply to their services. Apple is not a party to these Terms, has no obligation to maintain or support VidFuse, and is not responsible for claims relating to the Service. As required by the Apple Standard EULA, Apple and its subsidiaries are third-party beneficiaries and may enforce applicable provisions.
9. Purchases, Subscriptions, and Cloud Limits
Paid plans, trials, Cloud Camera Minutes, storage or transfer allowances, and Cloud Boost Packs are purchased through Apple unless stated otherwise. Prices, taxes, duration, included features, renewal terms, and trial terms displayed at purchase are incorporated into these Terms. Auto-renewing subscriptions continue until canceled through your Apple account settings, subject to Apple’s timing and cancellation rules. Deleting your VidFuse account does not cancel an Apple subscription.
Apple processes payments and applicable refunds. Except where Apple or law requires otherwise, purchases are nonrefundable and unused temporary allowances or promotional benefits may expire as disclosed at purchase. Plan limits are affected by resolution, bitrate, network conditions, retries, processing, and file size. We may prevent use beyond an entitlement or require an upgrade. No purchase guarantees perpetual access to a feature.
10. Devices, Networks, Storage, and Data Loss
You are responsible for compatible hardware, sufficient battery and storage, permissions, safe mounting, connectivity, backups, and carrier or internet costs. Cameras may disconnect; clocks may drift; files may corrupt; transfers, recordings, analyses, exports, or uploads may fail; and operating systems may interrupt the app. To the fullest extent allowed by law, VidFuse is not responsible for lost, delayed, incomplete, rotated, unsynchronized, inaccessible, or accidentally shared content.
11. VidFuse Intellectual Property, Feedback, and Rights Notices
The Service, software, branding, designs, and documentation—excluding your content—are owned by or licensed to VidFuse and protected by law. These Terms grant only a limited, revocable, nontransferable right to use the Service for its intended purpose. If you voluntarily provide feedback about the Service, you grant VidFuse a perpetual, worldwide, royalty-free right to use that feedback without restriction or compensation. This feedback license does not apply to your recordings or other user content.
Copyright, trademark, and other formal rights notices may be submitted through the VidFuse support form by selecting Legal. Include identification of the protected work, the challenged material, your contact information, a good-faith statement, and proof of authority. Do not knowingly submit a false notice.
12. Account Deletion and Retention
You may request account deletion through available account controls. VidFuse revokes account access when deletion begins, targets operational completion within 24 hours, and completes deletion within 30 days unless a documented legal, security, fraud-prevention, accounting, dispute, or technical recovery exception applies. Deletion removes VidFuse-controlled account data and cloud media according to the Privacy Policy. Limited records may remain for the periods described there.
Deleting your account does not cancel an Apple subscription, delete local media from every device, or erase copies already transferred, exported, saved, or shared with another user or third party. Protected recovery copies may persist temporarily, but completed deletion instructions are reapplied after a controlled restore.
13. Suspension, Termination, and Service Changes
You may stop using the Service at any time. We may suspend or terminate access, restrict features, or discontinue the Service for material violations, safety or security risk, nonpayment, legal requirements, fraud prevention, or operational necessity. When reasonably practicable, we will provide notice appropriate to the circumstances. Sections that by their nature should survive—including ownership, disclaimers, liability, indemnity, and disputes—survive termination.
We may update these Terms by posting a revised version and effective date and providing additional notice when required. Material changes apply prospectively unless law requires otherwise. If renewed acceptance is required, we will request it. If you do not agree to revised Terms, stop using the Service before they take effect.
When applicable law requires acknowledgment or renewed parent or guardian approval for a significant change, we may use Apple’s system-provided approval process and restrict access to the affected features or Service until the required action is completed.
14. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS. VIDFUSE DISCLAIMS EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT RECORDING, SYNCHRONIZATION, AUTOMATED EDITING, TRANSFER, STORAGE, EXPORT, LINKS, OR SHARING WILL BE UNINTERRUPTED, ERROR-FREE, OR PRESERVED. THESE DISCLAIMERS DO NOT LIMIT WARRANTIES OR CONSUMER RIGHTS THAT CANNOT LEGALLY BE DISCLAIMED.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIDFUSE AND ITS OWNERS, AFFILIATES, LICENSORS, VENDORS, AND PERSONNEL WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST CONTENT, PROFITS, REVENUE, DATA, GOODWILL, OR OPPORTUNITY; OR REPUTATIONAL, PRIVACY, OR PROPERTY HARM ARISING FROM THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. THEIR AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF US$100 OR THE AMOUNT YOU PAID VIDFUSE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
These exclusions and limits do not apply to liability that cannot legally be excluded or limited, including where applicable fraud, willful misconduct, gross negligence, personal injury, or mandatory privacy or consumer obligations.
16. Limited Indemnification
To the extent permitted by law, you will indemnify VidFuse and its owners, affiliates, licensors, vendors, and personnel against a third-party claim, and resulting losses and reasonable legal costs, to the extent caused by your unlawful recordings or content, infringement of another person’s rights, intentional misuse of the Service, or material breach of these Terms. You will reasonably cooperate in the defense. VidFuse will provide reasonable notice and will not settle a claim in a way that admits your wrongdoing or imposes a nonmonetary obligation on you without your consent.
This obligation does not apply to the extent a claim results from VidFuse’s negligence, unlawful conduct, breach, or a matter for which indemnification cannot legally be required. Nothing here creates an unlimited automatic duty for a consumer to defend VidFuse.
17. Governing Law, Disputes, and General Terms
Before filing a claim, submit a Legal request through the VidFuse support form with a description of the issue and requested resolution and allow 30 days for good-faith informal resolution. This requirement does not prevent urgent injunctive relief, an eligible small-claims action, or exercise of a right that cannot be delayed or waived.
Florida law governs these Terms, without regard to conflict-of-law rules. Subject to mandatory local consumer rights and forums, claims must be brought in the state courts located in Palm Beach County, Florida, or the applicable federal court in Florida. These Terms do not require arbitration or waive participation in a class action. Mandatory consumer protections, limitation periods, and forums where you live remain available.
These Terms, the Privacy Policy, purchase disclosures, and Apple Standard EULA constitute the applicable agreement for the Service. Invalid provisions will be narrowed or severed; no waiver is continuing; and headings are for convenience. You may not transfer these Terms without consent. VidFuse may transfer them in connection with a merger, financing, reorganization, sale, or transfer of the Service, subject to applicable notice and privacy obligations. Export-control and sanctions laws apply.
Neither party is responsible for delay caused by an event reasonably beyond its control if it uses reasonable efforts to mitigate the effect. This does not excuse mandatory privacy or security notices, obligations for completed payments, or refunds required by law or Apple.
18. Language and Contact
The counsel-approved English version is the canonical drafting source and is intended to control where legally permitted. Translations are provided to help users understand these Terms. A translation does not limit mandatory local-language disclosures, interpretations, consumer protections, or other non-waivable rights.
